This representation occurs both through retention directly by our business clients and through employment practices liability insurance carriers. Our attorneys handle a broad range of matters. These include providing representation in proceedings before the National Labor Relations Board, the U.S. Department of Labor and Tennessee Department of Labor, and in defending employers in discrimination charges before both the Equal Employment Opportunity Commission and the Tennessee Human Rights Commission. Additionally, we are involved in defending wrongful discharge claims related to workers’ compensation claims or arising under state and federal anti-discrimination statutes including the Americans With Disabilities Act, the Age Discrimination In Employment Act, Title VII, Civil Rights Act of 1964 and the Tennessee Human Rights Act, and other state law claims including defamation, tortuous interference with contractual relations and breach of contract. Further, we represent clients in matters involving ERISA, OSHA, the Family and Medical Leave Act and the Fair Labor Standards Act. Our lawyers have represented clients on various matters before all trial courts and appellate courts in Tennessee and the U.S. Court of Appeals for the Sixth Circuit. Manier & Herod also represents management in matters pertaining to the formation, administration and defense of independent contractor relationships with individuals before federal and state trial and appellate courts, as well as before state administrative bodies in various states across the country. Manier & Herod’s attorneys regularly counsel and advise clients on these matters in addition to providing representation in legal proceedings.
